1. About this Privacy Policy

1.1 NG Mobility is committed to respecting your right to privacy and protecting your personal information.

1.2 This policy is governed by the Privacy Act 1988 (Cth) (the "Act") and the Australian Privacy Principles (APPs) in Schedule 1 of the Act.

1.3 This policy describes how we collect, hold, use, and disclose your personal information and sensitive information. It applies to all your dealings with us, whether in person, by telephone, email, or correspondence, or through our website at ngmobility.com.au.

1.4 We review this policy from time to time, and whenever significant changes to our business occur, to ensure it continues to comply with the Act. The current version is always available on our website and is provided free of charge on request.

2. Definitions

In this policy, "personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information is true and whether or not it is recorded in material form. "Sensitive information" has the meaning given by section 6 of the Act and includes information about health, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, criminal record, and biometric information. All other terms have the meanings given by section 6 of the Act.

3. What personal information we collect

3.1 We only collect personal information that is reasonably necessary for, or directly related to, our functions and activities. The types of personal information we generally collect include:

  • name and date of birth;
  • residential, postal, and email addresses;
  • telephone numbers;
  • occupation and business address;
  • payment details and transaction history;
  • financial information required to assess or process payments (including finance applications processed by third-party providers); and
  • details you provide when participating in a promotion or contacting us.

3.2 Because we require certain personal information to process sales, deliveries, finance applications, and warranty claims, it is generally not practicable for you to deal with us anonymously or under a pseudonym.

4. How we collect personal information

4.1 We collect personal information directly from you by lawful and fair means, including when you place an order, create an account, complete a form, book a test ride or service, or contact us by any means of communication.

4.2 We may collect personal information from third parties or publicly available sources where it is unreasonable or impracticable to collect it directly from you, including from credit reporting agencies, finance providers, delivery partners, and other suppliers or service providers involved in our business.

4.3 If we receive personal information we did not solicit, we will determine within a reasonable period whether we could lawfully have collected it ourselves. If not, we will destroy or de-identify the information where it is lawful and reasonable to do so.

4.4 We will not use or disclose government-related identifiers (such as a tax file number) unless required or authorised by law.

5. Cookies and website analytics

5.1 Our website is hosted on the Shopify platform and uses cookies and similar technologies to operate the online store, remember your cart, process checkout, and analyse how visitors use the site.

5.2 We use analytics and advertising services (such as Google Analytics and social media advertising tools) that collect information about your device, browser, IP address, and browsing behaviour on our site. This information is used to measure site performance and to deliver relevant advertising.

5.3 You can manage or disable cookies through your browser settings. Doing so may affect the functionality of parts of the website, including checkout.

5.4 Payment card details are processed by our payment providers (such as Shopify Payments, Afterpay, and finance partners) and are not stored on our systems.

6. Sensitive information

6.1 We do not collect sensitive information about you unless you consent and the information is reasonably necessary for our functions or activities, or the collection is required or authorised by law.

6.2 In limited circumstances sensitive information may be revealed in your dealings with us, for example where you request a product with particular features related to a health condition or mobility need.

7. Use and disclosure of personal information

7.1 We use and disclose your personal information for the primary purpose of conducting our business, including: processing sales, payments, and deliveries; managing warranty claims, servicing, and returns; providing customer support; managing our business records; legal and insurance purposes; and marketing our products and services to you (see section 9).

7.2 To carry out these purposes, we may disclose your personal information to: our related entities; delivery and logistics partners; payment processors and finance providers; insurance providers and brokers; product manufacturers and distributors (for example, to register or process a warranty claim); professional advisers; providers who maintain and develop our business systems and website; organisations involved in a sale or restructure of our business; and government agencies where required.

7.3 We will not otherwise disclose your personal information unless you have consented, you would reasonably expect the disclosure, it is required or authorised by law, or it is reasonably necessary for enforcement-related activities conducted by or on behalf of an enforcement body.

8. Overseas disclosure

8.1 Some of our suppliers, manufacturers, and service providers (including cloud and e-commerce platforms) are located, or store data, outside Australia.

8.2 Where we disclose personal information to an overseas recipient in performing the purposes described in section 7, we take reasonable steps to ensure the recipient handles the information in accordance with the Australian Privacy Principles. We will not otherwise send your personal information outside Australia without your consent, except as permitted by the Act.

9. Direct marketing

9.1 We may use your personal information to send you marketing communications about our products and services, in accordance with the Act and the Spam Act 2003 (Cth).

9.2 Every marketing email we send includes a functional unsubscribe facility. You may also opt out of all direct marketing at any time by contacting our Privacy Officer using the details in section 13. We will action opt-out requests promptly.

9.3 We do not use sensitive information for marketing purposes without your consent.

10. Data quality, security, and retention

10.1 We take reasonable steps to ensure the personal information we hold is accurate, up to date, and complete.

10.2 We take reasonable steps to protect your personal information from misuse, interference, and loss, and from unauthorised access, modification, or disclosure. All officers, employees, and contractors who handle personal information are made aware of their obligations under the Act.

10.3 When personal information is no longer needed for any purpose for which it may be used or disclosed under the APPs, and we are not required by law to retain it, we take reasonable steps to destroy or de-identify it.

10.4 Our website contains links to third-party websites. We are not responsible for the privacy practices of those websites, and we encourage you to review their privacy policies.

11. Data breaches

11.1 We are subject to the Notifiable Data Breaches scheme under Part IIIC of the Act. If a data breach involving your personal information is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Act, and take prompt steps to contain and remediate the breach.

12. Access and correction

12.1 You may request access to the personal information we hold about you, and request correction of any inaccurate, out-of-date, or incomplete information, by contacting our Privacy Officer.

12.2 We will verify your identity before providing access. Access requests are free of charge; however, we may charge a reasonable fee to cover the cost of locating, retrieving, and copying material, and will advise you of any cost in advance where you ask us to.

12.3 We will respond to access and correction requests within a reasonable period. If we refuse a request, we will give you written reasons and information about how to complain about the refusal, except where the Act permits otherwise.
